Botched Wisdom Tooth Extraction Patient Receives $9.8 Million from Jury

Design Pics/Thinkstock(WHITE PLAINS, N.Y.) -- On Friday, a White Plains jury awarded the staggering sum of $9.8 million to a man, 49, who suffered sustained injuries due to a botched wisdom tooth extraction.

According to the plaintiff, he went to Dr. William Moody for a toothache and was treated three unsuccessful times in removing the wisdom tooth.

Although the plaintiff believed the extraction was completed the last visit with Dr. Moody, he went to the emergency room at White Plains Hospital hours after his last dentist appointment and was transferred to Westchester County Medical Center. Here, the patient was treated by Dr. Michael Miller, who surgically extracted the remaining roots, but never actually saw or examined the plaintiff prior to the surgery, even though the patient spent four days at the hospital.

Dr. Moody and Dr. Miller were both considered liable for the injuries and failed to obtain an informed consent, according to the jury.

The plaintiff has been unable to return to work as a hydro-geologist, and is completely disabled as a result of his constant pain.
